How to Avail IRS Relief?

An IRS relief attorney may come to your rescue in case you receive a Notice of Federal tax Lien. The Notice is filed, in case, the tax payer does not pay within 10 days despite having been informed about the debt. IRS is supposed to inform the taxpayer within 5 days of filing that he has a right to hearing.

You may look for a tax relief attorney to seek solace from the lien against your property. If you successfully disagree with the lien at the court hearing, you may appeal to the US Tax Court or federal district court.

The taxpayer may avail IRS relief in case one or more of the following conditions are fulfilled:

  • If the notice is filed prematurely.
  • If the notice does not adhere to the rules of administrative procedures.
  • If both the taxpayer and the government are benefitted by the withdrawal.
  • If an installment plan has been agreed upon.
  • If the taxpayer makes the payment.
  • The case may be reassessed if the taxpayer has been critically ill or there have been other unavoidable circumstances. These may include the death of a near or dear one, improper advice as provided by a tax advisor, a grave service error in the services provided by a company that advices on IRS relief, etc. Besides, if the taxpayer has been fulfilling all the obligations to IRS in the past, and reason for a delay in the payment has been unavoidable as well, the taxpayer may hope to avail the IRS relief.
  • IRS relief may also be availed on grounds of the Innocent Spouse Relief. All those who have been compelled to pay the tax simply because they signed a joint tax return form wrongly filled in by their spouse may avail of IRS relief. IRS will focus entirely on the wrongdoings of the spouse and the innocent taxpayer may avail the relief.

However, the problem gets aggravated when the taxpayer finds himself in dark concerning the rules to avail IRS relief. Consulting an IRS relief attorney is advisable. An expert attorney is well aware of the criteria, procedures and the rules that IRS follows while declaring tax penalties. It’s only an attorney who can look into the type of penalties imposed upon you by IRS and find a legally acceptable way to remedy them. There are penalties for the unpaid taxes, for not filing a return, or even for violating the rules while filing a return. In case, you fail to reveal the truthful information sought by IRS while filing returns, you may suffer penalties on these grounds as well. The total number of penalties for various reasons total up to more than 140. And it’s only a tax attorney who can figure out as to what has gone wrong and how it can be remedied.

The tax attorney, besides getting you the relief, may also help you getting an extension from IRS as well.
