Would you like to pay IRS taxes when you are not supposed to be doing so? Of course not! You are quite sure that you do not owe IRS any taxes at all. But there is the letter in your hand that declares openly that you owe a huge amount. However, IRS must have the taxes paid. Who bothers whether they are being charged fairly or otherwise? Availing IRS relief may be a complex task.
Here are few tips that let you know how to face IRS if it is unfair to you and avail IRS relief:
- The letter/mail is accompanied by a grave warning from IRS – The letter may include a warning similar to "If the Tax Court determines that your case is intended primarily to cause a delay, or that your position is frivolous or groundless, the Tax Court may award a penalty of up to $25,000 to the United States in its decision." In order to escape the penalty, and avail IRS relief at the earliest, make sure that you do not move the court on frivolous grounds. Your application seeking the relief must include all the documents to prove that you earnestly seek back tax relief.
- IRS does not admit a mistake – Though it is human to err, IRS is not like to admit that a mistake has been made. Even if you are being made to pay the taxes unjustifiably, you must pay them simply because you are asked to! Now, if you must succeed to avail IRS relief, be fully prepared to do so! You may approach a tax relief attorney who may help you prove that IRS has not been fair to you.
- You are left with no option, but take IRS to court – IRS will try whatever it’s allowed by the constitution. It will spare no legal measure to charge the tax. So, before you think of moving the court, think not twice, but ten times at least! Chances are, rather than getting IRS relief, you may be fined for having wasted the time of the court, that of IRS, and the expenditure involved and payed by IRS during the legal proceedings.
- Time to petition the debt – Once you receive the certified letter from IRS that demands that you pay the tax; you have 90 days to petition the debt and seek IRS relief. After the petition has been filed, you may expect a hearing in the case. And once again, be sure that you are being charged the taxes unjustifiably lest you may be made to pay an additional $25,000!
- Office of appeals – You may not require a legal representation for various purposes. Whatever your grievance against IRS, it’s advisable to knock at the office of appeals to seek IRS relief rather than moving the court. You may claim a case request seeking help from the office of appeals in case if you owe less than $25,000 to IRS. IRS will ask one of its representatives to talk to you at the office of appeals and the entire issue may be settled over there.
Finally, whatever the court or the IRS representative decides at the office of appeals, you must be ready to fight a tough battle. It’s you who has not payed the debt. And in case, if you have, it’s not so easy to prove that either! The point to be driven back home is that be very careful before you wage the war!
